MiCA in Poland

Poland supervises its banks, payment institutions and capital market through the Polish Financial Supervision Authority (KNF). For crypto the KNF has no MiCA powers: the act that would make it the competent authority under MiCA was vetoed by the president three times, on December 1, 2025, February 12, 2026 and June 11, 2026. Three vetoes

The president vetoed the act on the crypto-assets market on December 1, 2025 and, after parliament passed it again, on February 12, 2026. The objections included the power to block websites and the length of the law, Dudkowiak reports. The bill gave the KNF the power to suspend offerings, block websites and impose fines, Cryptometer notes. A third veto followed on June 11, 2026, according to the law firm Skarbiec.

What the gap means for firms and clients

Polish crypto firms were entered in a national register for virtual currency providers and could keep working under the MiCA transitional period until July 1, 2026. Without a competent authority none of them could obtain a MiCA license in Poland: in April 2026 the country had no authorized CASP, against 53 in Germany, 25 in the Netherlands and 12 in Malta, Skarbiec counted. A firm can apply in another member state and passport its license into Poland, which is how providers licensed in Malta, Austria or Luxembourg serve Polish clients. Complaints from those clients go to the foreign supervisor.

Skarbiec cites the ZondaCrypto case, in which thousands of Polish clients are still trying to recover their funds, as an example of the cost of a supervisory gap.

Where Poland stands in the EU

MiCA applies directly in every member state, but each state has to designate a competent authority and set penalties in national law. Germany did so with the Crypto Markets Supervision Act (KMAG), which names BaFin; the page on MiCA in Germany describes it. The transitional period page lists when other countries closed their grandfathering.

Can a crypto firm get a MiCA license in Poland?

Not while no authority is designated. A firm can get a license in another member state and passport it into Poland.

Who supervises crypto providers that serve Polish clients?

The home authority of the provider, for example in Malta or Austria. Without the act, the KNF has no MiCA licensing powers.
