Crypto Assets Frankfurt

Crypto-assets in Frankfurt cover digital holdings recorded and transferred through blockchain or similar technology. Banks, trading providers and custodians build services around the purchase, safekeeping and movement of these assets. Understanding what a token represents helps distinguish a cryptocurrency from a tokenized security and identify the services needed to use it.

Frankfurt brings those services into contact with established banking and capital markets operations. A trading provider arranges an exchange, while a custodian manages the credentials controlling a customer's holding. The asset's legal classification and the provider's responsibilities determine how these activities fit into the regulated financial market.

Why Frankfurt treats crypto assets as a regulated asset class

The rights attached to a token determine its regulatory classification. BaFin supervises crypto-asset service providers in Germany under the EU's Markets in Crypto-Assets Regulation (MiCA). The European Securities and Markets Authority develops draft technical standards. Providers generally need MiCA authorization; eligible institutions can use Article 60's notification procedure. Cross-border services require a separate notification under Article 65.

A token that qualifies as a financial instrument is outside MiCA's scope under Article 2(4)(a). Tokenization does not remove securities-law requirements. The provider's activities and existing permissions determine which authorizations it needs. Germany's Electronic Securities Act (eWpG) permits electronic issuance of the securities within its scope; it does not give an issuer or service provider a general investment-firm license.

Custody: banks move from crypto pilots to licensed services

Deutsche Bank plans to launch custody for institutional and corporate clients in 2026, subject to completion of the regulatory process. Its 16 September announcement names bitcoin and ether, alongside selected stablecoins including USDC, EURC and EURAU. Custody includes managing clients' wallets and private keys. MiCA custody requirements are distinct from the rules for securities custody.

Clearstream, part of Deutsche Börse Group, uses Crypto Finance as its crypto sub-custodian and added six cryptocurrencies to its offering in July 2026. A credit institution can provide crypto-asset services through Article 60, without obtaining a separate CASP authorization. It must submit the required notification at least 40 working days before first providing the services; it cannot start while the notification is incomplete.

Tokenized securities and real-world assets

A tokenized bond or fund share that qualifies as a financial instrument falls under the applicable securities framework, including MiFID II, and is excluded from MiCA. Whether an electronic security is covered by the eWpG depends on its legal form. A token linked to real estate is not automatically a security: its rights and structure need assessment. An issuer does not become an investment firm simply by tokenizing an asset. Authorization requirements depend on the services provided, such as investment advice or order execution, and on the provider's existing permissions.

The Frankfurt School Blockchain Center and the Frankfurt School Centre for Digital Economics both research this line between crypto-asset and security law, and their work feeds directly into how the city's banks and law firms structure a tokenization deal.

What license does a crypto-asset service provider need in Frankfurt?

A provider of crypto-asset services within MiCA's scope generally needs CASP authorization from the competent authority of its home member state. In Germany, that authority is BaFin. Article 60 provides a notification route for eligible regulated institutions, with the permitted services depending on the institution type and its existing permissions. EU cross-border provision requires the Article 65 notification; a provider does not need a separate MiCA authorization in each host member state.

Is a tokenized security the same as a crypto asset?

A tokenized security can meet the broad definition of a crypto-asset, but if it qualifies as a financial instrument, Article 2(4)(a) excludes it from MiCA. Securities rules then apply. The security itself does not obtain an investment-firm authorization. Any authorization requirement concerns the issuer's or service provider's activities and depends on the business model and existing permissions.
